Introduction
This Return & Refund Policy explains when and how you can get a refund for payments made to Smart Karobar Pty Ltd for SmartKarobar. It forms part of our Terms of Service (see sections 5 and 17) and doesn’t limit any rights you have under the Australian Consumer Law.
1. What this policy covers
This policy applies to:
- business plan subscriptions, for any billing period (for example monthly, quarterly or yearly); and
- one-off fees, such as the fee for posting an opportunity.
Using the free parts of SmartKarobar — such as a personal account, browsing opportunities and the library — costs nothing, so there is nothing to refund.
2. Returns and our general approach
SmartKarobar is a digital service, so there are no physical goods to return. “Returning” a plan means cancelling it (section 3); a refund is available in the situations set out in sections 5 and 6.
Plans are paid in advance for the billing period you choose. Unless stated otherwise, fees are non-refundable once the billing period has started, and we don’t provide pro-rata refunds for the unused part of a period. The same applies to one-off fees once the service they pay for — for example, publishing an opportunity — has been provided.
This general rule never overrides the situations in section 5 or your rights under the Australian Consumer Law in section 6.
3. Cancelling a plan
You can cancel a paid plan at any time. Cancellation takes effect at the end of your current billing period, and you keep access to your plan’s features until then. You won’t be charged for any later period.
Where we offer a free trial, cancelling before the trial ends means you won’t be charged.
4. Upgrades and downgrades
- Upgrades take effect straight away. The unused value of your current period is credited pro rata against the price of the new plan, so you only pay the difference.
- Downgrades take effect at the end of your current period, so you keep what you’ve already paid for and pay the lower price from the next period.
- Plan credit is applied to plan charges only and isn’t paid out as cash. No credit is given between plans priced in different currencies.
5. When we will refund
We will refund you, in full or in part as appropriate, where:
- you were charged more than once for the same thing, or charged the wrong amount;
- you were charged for a period that started after your cancellation took effect;
- we couldn’t provide the service you paid for — for example, an extended outage caused by us, or a paid feature we withdrew before the end of the period you paid for; or
- a refund is otherwise required by law, including under the Australian Consumer Law.
We may also consider a refund in other circumstances at our discretion — if something has gone wrong, please get in touch.
6. Your rights under Australian Consumer Law
Our services come with guarantees that can’t be excluded under the Australian Consumer Law. If there’s a major failure with the service, you’re entitled to cancel and receive a refund for the unused portion, or to compensation for its reduced value. You’re also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure doesn’t amount to a major failure, you’re entitled to have the problem fixed within a reasonable time and, if that isn’t done, to cancel and obtain a refund for the unused portion.
7. How to request a refund
Email support@smartkarobar.com from the email address on your account, and include:
- your name and, for a business plan, the business name or business ID;
- the date and amount of the payment; and
- why you’re asking for a refund.
We’ll acknowledge your request within 5 business days and let you know the outcome, with reasons, as soon as we’ve looked into it.
8. How refunds are paid
Approved refunds are paid back using the original payment method where possible, or otherwise to an account you nominate, in the currency you paid in. We aim to process approved refunds within 10 business days; your bank or card provider may take a few extra days to show the money in your account.
9. Changes to this policy
We may update this policy from time to time. Changes won’t affect a payment made before the change took effect. We’ll post the updated version here with a new “last updated” date.
